From 1 January 2026, an amendment to Czech family law has changed the rules of divorce. The aim is to make the process simpler, faster and less stressful, especially if both spouses agree. Courts generally no longer examine the reasons for the breakdown of the marriage if both spouses agree that the marriage has irretrievably broken down.

Arrangements for children - If the spouses have minor children, it is necessary to determine custody and child support. Since 2026, divorce and child-related matters are usually decided in one single proceeding, which makes the process faster and more efficient.
Property settlement - It is advisable to address the division of marital property during the divorce.
Filing the petition with the court - The divorce petition is filed with a district court in the Czech Republic. If both spouses agree on all key issues, the process can be significantly faster and less complicated.
