Buying property in the Czech Republic


Buying property in the Czech Republic can be a great opportunity, whether you are planning to live here or invest. However, for foreigners, the process may be more complex due to legal, language and administrative differences. Mistakes when purchasing property can lead to financial loss, delays in ownership transfer or long-term legal complications.



What should you pay attention to?

Check the legal status of the property - the first and most important step is to verify the property in the Czech Land Register (Cadastre). You should always check who the legal owner is, whether there are any mortgages, liens or easements, whether the property is subject to enforcement or legal disputes. Failing to properly verify the legal status may result in purchasing a property with hidden legal burdens.

Review the technical condition - in addition to legal checks, it is important to assess the technical condition of the property.

Be careful with reservation agreements - a reservation agreement is often the first document you sign. It should clearly define the property, the reservation fee, conditions for refund and deadlines for signing the purchase contract. Poorly drafted agreements may result in losing your deposit.

Carefully review the purchase contract - the purchase contract is the key document in the transaction. It should be thoroughly reviewed, especially regarding correct identification of the parties, precise description of the property, purchase price and payment terms, conditions for transfer and handover and declarations about legal and factual condition. Even small errors can lead to rejection by the Land Register or future disputes.

Secure payment of the purchase price - the purchase price should always be handled securely, typically through lawyer’s escrow, notary escrow or bank escrow. Funds should only be released after the ownership transfer is completed. This significantly reduces the risk of losing your money.

Financing and timing - if you are financing the purchase with a mortgage, it is important to align the purchase contract, the bank’s conditions and the payment schedule. Incorrect timing can delay or even prevent completion of the transaction.
